Steinberg Law Initiates Consumer Class Action Against StubHub Alleging Ticket Scalping Practices

Steinberg Law and attorney Keven Steinberg are serving as lead counsel in a proposed nationwide class action against StubHub Holdings, Inc. and its founder, CEO, and chairman, Eric H. Baker. Steinberg Law is working alongside Rich Daniels and Steve Mirsky of Mirsky Corporate Advisors in representing the plaintiff and proposed class.

The lawsuit, Sanquini v. StubHub Holdings, Inc., et al., was filed in the U.S. District Court for the Southern District of New York. It alleges that StubHub marketed itself to consumers as a neutral marketplace connecting independent ticket buyers and sellers while failing to adequately disclose certain financial relationships involving its leadership and professional ticket-resale operations.

According to the complaint, Baker has an ownership and management role in Andro Capital, a professional ticket reseller that has sold tickets through StubHub’s platform. The complaint also alleges that StubHub maintained financial and referral arrangements involving Andro Capital and its affiliate, Colloquy Capital.

The plaintiff alleges that consumers purchased tickets believing they were participating in a neutral, fan-to-fan marketplace and that the undisclosed relationships were material to their purchasing decisions. The lawsuit asserts claims including fraudulent concealment and misrepresentation, violations of consumer-protection laws, unjust enrichment, and breach of the implied covenant of good faith and fair dealing.

“This case is about transparency and consumer trust,” Keven Steinberg said. “Consumers deserve complete and accurate information when making purchasing decisions, particularly when a platform represents itself as a neutral marketplace.”

The lawsuit seeks to represent consumers nationwide who purchased and received tickets through StubHub without allegedly being informed of the relationships described in the complaint. The case concerns alleged disclosure and pricing injuries and is separate from claims involving canceled, invalid, or undelivered tickets.

The allegations have not yet been proven, and the proposed class has not been certified by the court.
